TitleSettlement by way of assignment of £1000.
Description1. Mary Willson of Barton, Cambridgeshire, spinster. 2. William Willson of St Ives, draper. 3. Joseph Willson of Great Oakley, Essex, policeman. 4. The said William Willson [2]. 5. George Newton Day of St Ives, gentleman. Consideration: £714 15s and the interest on the sum of £285 4s 2d. Recites that Ann Willson, by her will and two codicils dated 20 June 1831, 12 July 1837 and 17 January 1845 respectively, left all her lands and personal estate to her daughter the said Mary Willson (1), and after her decease to her grandsons John Willson, Robert Willson, Jonathan Willson and William Willson. Recites that the said Ann Willson died on the 24 August 1845. Recites that the lands devised to the said Mary Willson consisted of one undivided fourth part of lands in Elsworth to which the said M.W. became seized for her life and to which the said grandchildren were entitled to after her death as remainder as tenants in common in fee. Recites that the tenants of the other three undivided fourth parts of the said lands wished to sell all the lands in their entirety. Therefore the said M.W. agreed to sell her life interest in the said undivided fourth part, provided she was allowed to receive the interest of the purchase money instead of the amount of the ascertained value of her life interest. Recites that the said lands had been sold and the proceeds for one fourth part being £1000 therefore the said M.W. was entitled to £285 4s 2d as her life interest and the sum of £714 15s 10d being the residue on the said purchase money. Therefore the said M.W. wished to assign the said sum of £285 4s 2d to the said George Newton Day (5) in trust after her death for the benefit of the said William Willson and John Willson. Recited indenture dated 9 June 1858 by which Robert Willson conveyed his share of the life interest in the said lands at Elsworth and money bequeathed to him by the will of the said Ann Willson to a Frederick Mutton of St Ives, money lender and news vendor. Recites indenture dated 18 June 1858 by which the said Frederick Mutton assigned the above to the said William Willson (2). Recites indenture dated 3 September 1858 by which the said Jonathan Page Willson conveyed his life interest in the said lands at Elsworth to the said William Willson (2). This indenture now witnesses that the said M.W. assigns to 5 the said sum of £285 14s 2d upon trust to invest the same and pay the interest thereof to the said M.W. for her life, and after her death to 5 in trust to divide the same as follows: three fourth parts to the said William Willson; one fourth part to the said John Willson. And this indenture further witnesses that the said W.W. and J.W. assign to 5 the said sum of £714 15s 10d upon trust to invest the same and pay the interest to the said M.W. during her life, and after her death to divide the said sum as beforehand.
