(Hinch 2/52) 2) The £500 remains due to 1., but all the interest has been paid. 3) 1. has applied to 2. for repayment of the £500, and 2. has applied to 4. to lend him the same. Now for £500 from 4., by direction of 2 and 3, to 1 1., by the direction of 2 and 3. assigns to 4. and constitutes 4 his attorney for any actions against 2 and 3 over the said Declaration. Mortgage (by Assignment of Declaration of Trust) 28th May, 1789 1. Chamberlain Goodwin of Battersea Rise, co. Surrey, Esq. 2. John Lawrence of Huntingdon, co. Huntingdon, Draper. Recites: 1) Lease and Release of 1st-2nd September, 1784 (Hinch 2/51) 2) Declaration of Trust of 8th March, 1785, annexed to an attested copy of the Release of recital 1. This recites that 1., then of Park Street in the borough of Southwark, co. Surrey, paid £500 to Robert Palmer, Robert Mackreth and Robert Burton, to be applied by them, for the benefit of John, 4th Earl of Sandwich, towards the making up of the sum of £25,000 mentioned in recital 1. 3) Bond of 28th May, 1789. 1 bound to 2 in £1,000 to fulfil the covenants in the present deed. Now 1 assigns to 2 the sum of £500 secured as recited in 1) & 2) and it is agreed that Robert Palmer, Robert Mackreth and Robert Burton will hold part of the recited security in trust for 2. |
