TitleAssignment of a Term in Trust (and Counterpart)
Description(1) John Cotton, Conington, Bart. John Proby, Elton, Esq. Robert Cotton, Steeple Gidding, Esq., uncle of Sir John Cotton. Sir Miles Heneage, Hatton Garden, Middx., Kt. (2) Charles Bates, Westminster, Esq. Thomas Hewet, St. Giles in the Fields, Middx., Dr. in Physick. Recites: (i) Release of 28 May, 1675, setting up a term of 21 years, to raise £6,000 from the Manors of Conington, Glatton and Holme with apps. (ii) Will of Sir John Cotton, Bart, of 11 Aug. 1701 directing disposition of said £6,000. (iii) Death of Margaret Walden, under 18 and unmarried and death of Cotton Walden, under 21, so that Elizabeth and Hester Walden, infants, are entitled to their share. (iv) Order of Court of Chancery of 11 June, 1706 in a cause pending between Henry Smith and Elizabeth, his wife, dau. of Sir John Cotton, decd., and mother of Elizabeth and Hester Walden, complainants, and Sir John Cotton, Bart, Robert Cotton, Esq., and John Proby, Esq., defendants, decreeing that Sir John Cotton should pay the said £4,000 in 4 months; further decreed that the defendants the trustees should assign the term created by the late Sir John Cotton to the person appointed by the defendant Sir John Cotton: further ordered that the £4,000 having been paid should be placed out at interest, on security to be approved by Sir Lacon William Child, one of the masters of the Court, for the benefit of the said infants. (v) Payment of the interest on the £4,000; proposal of John Rooper of St. Giles in the Fields, to borrow the £4,000, and approval of Sir Lacon William Childs of the security proposed and of indenture sexpartite of even date made for that purpose: payment of the £4,000 on the said security by Sir John Cotton in trust for the said infants. (2) pay 5/- to Sir Miles Heneage. He, with the consent of the rest of (1), and in pursuance of decree of 11 June, 1706, assigns to (2) all the Manors. lands etc; limited to the said Sir Miles Heneage, Sir Thomas Proby and John Lannott Honywood, for the term of 21 years, for the residue of the term remaining, to attend the freehold of such part as are settled by Lease and Release of 2 and 3 July, 1708, for the said Sir John Cotton and heirs. Enclosed: Report of Sir Lacon Wm. Childs, 15 Jan. 1708 in case of Smyth versus Sir John Cotton, Bart., Robert Cotton, Esq., and John Proby, Esq. Approves of security proposed and of Indenture sexpartite of even date made for that purpose.
