Description(1) John Heathcote, North Luffenham, Rutland, Esq. (2) Sir Gilbert Heathcote, Normanton, Rutland, Bart., bro. of (1). (3) John Hewett, Shire Oaks, Notts., Esq. Recites: (i) Lease/Release of 21/22 June, 1771, release reciting Mary Cotton decd., being right heir of Sir John C. the grandfather and also reciting will of said Mary of (10) Feb. 1838 leaving everything to her mother, Frances C., and also reciting settlement of (1 August) 1753, which levied a fine, giving quarters of the Manor etc. to each of the Cotton heiresses and their husbands; further reciting in the release of 22 June, 1771 that by Release/Lease of 15/16 Oct. 1764, Jane Hart and John Hart Cotton released to Sir Robt. Burdett and Charles Jennens their ¼ in the manor of Gidding Abbotts, with advowson,, lands and apps. to use of John Hart Cotton. Reciting that Frances Cotton was seised in fee simple of another ¼. Indenture of 19 March, 1756 reciting fine levied by indenture of 1 Aug. 1753. The Bowdlers by the power then given directed their ¼ to use of Thomas Bowdler and Arthur Annesley - to Annesley in trust for Bowdler. Also reciting indentures of Lease/Release of 1/2 April, 1757 - marriage settlement of Mary Cotton by which her ¼ was conveyed to Sir Cordell Firebrace, Sir Robt. Burdett, and Charles Jennens; giving them the right to convey it to any purchaser. Firebrace now being dead, legal estate vested in Burdett and Jennens and by a deed poll of 20 June last the Earl and Countess of Denbigh directed Burdett and Jennens to Bargain and Sale and convey their ¼. And reciting that (1) has agreed with all the Cotton heiresses, their husbands and trustees, for the purchase of their several ¼'s for £22,800: it is by the said release of 22 June 1771 witnessed that for £5,700 apiece John Hart Cotton, Frances Cotton, Thomas Bowdler and The Earl and Countess of Denbigh released their ¼'s to (1). (ii) Deed poll of (1) of 29 June 1771, reciting Lease/Release of 21/22 June, 1771, wherein (1) declared that the £22,800 was (2)'s and (1)'s name was used in trust for the use of (2), and (1) agreed with (2) to convey the said lands to (2) or anyone (2) appoints. (2) now wishes to settle the said Manor etc. into the several uses and trusts hereinafter mentioned. Now for 10/- paid to (1) by (3), (1) and (2) release to (3), in possession by a lease of yesterday. Manor of Gidding Abbotts with apps. Advowson of Steeple Gidding Church, Manor House and lands (field names and acreages given). To the following uses and trusts: For (2) to have for life the annual rent of £400, subject to this; To use of (3) for term of 200 years on trust. After determination of term; to use of (1) for ever; provided that from and after the death of (2), the residue of the term shall cease.
