TitleDeclaration of Trusts and Revoking of Former Trusts.
Description(1) Sir Gilbert Heathcote, Normanton, Rutland, Bart. The Hon. Marmaduke Langley, late of Elmer, Surrey, now of Wykeham Abbey, Yorks, formerly called Dawnay. (2) The Rt. Hon. and Rev. Wm. Henry Lord Viscount Downe, and Lydia, Viscountess Downe, his wife. (3) John Heathcote, Conington Castle, Esq. (4) The Rev. Robert Boothby Heathcote, Rector of Chingford, Essex, clerk. Recites: (i) Settlement of ¾ June, 1811. (ii) Death of Lydia Heathcote, the mother. (iii) Capital messuage of which moiety was limited in settlement lately pulled down with consent of (1) and (2). (iv) (1) have agreed, at request of (2), to sell site of said house to (3) for £410. (v) (3) having paid said sum to (1) as surviving trustees. (vi) (3) desiring property to be appointed to the following uses. Now; therefore, (1) revoke trusts in settlement of ¾ June, 1811 and limit said property to trusts and uses desired by (3), i.e. to (3) for life - then to (4) during life of (3) for (3) in trust and to prevent (3)'s wife getting dower from them, then to (3) and heirs for ever. Property = moiety of freehold premises in Low Leyton, Essex. Usual covenants. Endorsed: Receipt from (1) to (3) for £410.
