Description	(1) Ralph Fresselique, New Court, Throgmorton St., City of London, gent, sole exor. of the will of Robt. Boothby, late of Chingford, Essex, Esq., decd. (2) John Heathcote, Charles St., St. George, Hanover Sq., Middx., Esq. and Lydia his wife, legatees named in the last will of said Robt. Boothby. Recites: (i) being entitled to property under will of Robt. Boothby and some disputes having arisen between (2) and (1) re. said property to which (1) also laid claim on account of moneys advanced on account of said Robt. Boothby in his lifetime. (2) and others claiming under the will of said Robt. Boothby lately filed a bill in the High Court of Chancery against (1) as exor. of Robt. B. and said suit is still depending. (ii) In order to terminate said suit (2) have agreed to pay £105 to (1) and to cause bill of complaint in said suit to be dismissed without costs. And that (2) will give a general release to (1) of all claims which they have against him against him. And (1) agrees to accept set sum and give a general release to (2) from all claims. Now in pursuance of said agreements it is agreed by (1) and (2) that the said suit commenced against (1) cease and dismissed without costs by (2). (2) to (1). All actions, suits etc. (1) to (2) for £105. All actions, suits etc. Added: Receipt from (1) to (2) for £105.
