TitleAgreement (Draft); For securing the stipend of the living of C.
DescriptionRecites: 1) Sir John Heathcote, in 1753 contracting with the Cotton heiresses for the absolute purchase of their estate in the Manor of C. and of the Advowson of C. church which premises were to him conveyed. 2) At the time £60 was supposed to be issuing out of the said lands to the Rector of C. which, with the glebe lands, were in lieu of tithes. 3) It was doscovered after the contract and before the conveyance that only the £40 p.a. was charged on the Manor of C. but that by a Deed Poll of 17 Aug. 1718, made by Sir John Cotton, cousin of the last Sir John, £20 p.a. was charged on the Manor of Glatton and Holme payable to the said Rector. 4) It appeared that the Estate at C. was of greater value than the estimate delivered to Sir John Heathcote, and therefore, the said Sir John, has gone on paying the said £20. Now Sir John Heathcote is willing to make a reasonable compensation for the real value of the said £20 p.a. on condition that the Manor of C. is kept clear from any demands of tythe in kind from the Rectors of C. And will go on paying the £20 until such compensation is made so long as the Rector remains content with the present payments. And if any compensation or exchange of lands is made to the owners of Glatton and Holme, it shall be on condition that the said Annuity becoming void it shall from thenceforth be payable to Sir John Heathcote.
