Description(1) Robert Wilmot, the elder, Osmaston, Derbys., Esq. and Ursula, his wife, who was one of the daus. and co-heirs of Sir Samuel Marrow, late of Berkeswell, Warwicks, Kt., Bart. (2) Robert Wilmot, the younger, son and heir app. of (1). (3) Benjamin Johnson, Inner Temple, London, gent. Foot Gregg of the Six Clerks' Office in Chancery Lane, London, gent. (4) Edward Wilmot, Middle Temple, London, gent. Robert Charnells, Swepston, Leics., gent. For settling estates to the following uses and for £10, (1) and (2) to (3) ((3) in possession by lease of yesterday). Manor of Osmaston, Derbys. with apps. Messuage in Osmaston where (1) dwells and all apps. All property of (1) and (2) in Osmaston. The tythes of corn and grain in Litchurch, Derbys. All lands in Osmaston received in exchange by a deed of 12 Jan. 1708. Tythe of corn and grain and hay, moor and meadow tytheable in Osmaston. And all messuages and lands of (1) in Weston-on-Trent, Derbys. All the west moiety of the ground purchased by Robt. Wilmot, decd, father of (1), called The Hollow, as formerly divided. All lands of (1) and (2) in Burrow Ash and Spoondon, Derbys. And all that divided moiety of a grange called Newton Grange. All lands of (1) and (2) in Newton Grange. 1/5th of the Manor of Rushton Spencer, Staffs and all lands of (1) and (2) there. And all lands of (1) and (2) in Audley, Staffs. And all property in Aston, Wilne and Shardlow, Derbys, and Talk upon the Hill, Staffs. And all lands given or had in exchange for the before-mentioned premises, except the house in Eardley End, Audley called Eardley Hall and the following parcels of land - Eardley Demash, viz. Brick Field, Crockitts Great Field, Crockitts Little Field, Great Riddings Hodgekey, Yewtree Field, Stoney Flatt, Cow Hay, Cawdy Croft, Hall Meadow including the Drumble, Smithey Field Wood, Smithey Field including the Dromble, Ouley Croft, Peartree Field including the Dromble, Eardley Field including the Dromble, Moss Drumble, Winter Pasture, Moss Meadow, Moss Mosshouse Orchard and Well Croft, Moss-house Croft, Four Day Work, Long Meadow, Seven Butts, Moss Bank, Great Grese, Stable Croft Meadow, Stuble Croft, Four Pitts, another Four Pitts, Birch Field meadow, Birch Field, Swingoe Tree Hill, Birch Tree Wood including the Drumble, Homes Croft including the Drumble and Homes Croft Wood. And except the Old Field, Meadow Field, the ¾ Pool Field, Drumble Bigger Hurst, Lesser Hurst, High Field, Middle Field, Barn Field als. the Yards to the House (30a.1r.) all in Eardley, Audley, Staffs. (1) Agree with (4) that (1) and (2) will levy to (3) two or more Fines of aforesaid property on trust for (3) to be seised of said lands until two or more Common Recoveries are suffered with (3) as tenants and (1) and (2) as vouchees with treble voucher. To the following uses: Manor of Osmaston with lands there (field-names given). And messuage and lands in Weston-on-Trent (names given). To use of (4) and heirs in trust to join with (2) in such conveyances of the premises to whoever (2) appoints and to use said money as (1) and (2) shall appoint by deeds of tomorrow. To pay any surplus to (2). And (4) to be seised of any left for use of (2). And one messuage, 1 meadow and croft and adjoining piece at Newton Grange, nr. Ashburn, Derbys., now in possession of widow of William Bourne. Also the Stable flatt divided into 3 parts. Upper Painster, Nether Poinster Newton or Tougam Moor now divided into 4 or 5 parts at Newton Grange, 1 barn and foldyard, Edge Close, Rill Croft and The Paddock in Newton Grange now Wm. Finey. Cottage in Newton Grange now George Milward. Meadow there - Endale als Newton Meadow and Stanlow and 2 or 3 pieces called Brecks belonging to Stanlow in possession of Wm. Finey, gent, or - Greensmith. Close in Spondon and Burrow - Ash called Parson Holme. Messuage at Crown Bank adjoining Talk on the Hill, Audley. The Over Croft, Middle Croft, Nether Croft, Brook Field, Crown Meadow in 2 parts, Ludgate Finney, Near Rye Croft, Middle Rye Croft, Far Rye Croft, Sidnal, Sidnal Meadow, in 2 parts, Sidnal Meadow Bottom, Sidnal Rough, Audley. Messuage + apps., the field to the house, the Meadow Well, Meadow Broom Field, Bryan Hill Folly, Ellerfields, Upper and Lower Paddocks, Rye Croft, Audley. Tenement and 2 crofts called The Tow Crofts, Audley. House with apps. at Talk on the Hill, Audley, in possession of Thomas Wood. A shop at Talk on the Hill now in possession of William Brassington To use that (4) shall, during joint lives of (1) take out of Newton Grange the annual sum of £200 to use of Robt. Wilmot the elder for life then to Ursula Wilmot for life. Then to (2) and heirs for ever. And 1/5th of the manor of Rushton Spencer, Staffs, And messuage there called the Hall House and closes belonging (named). Messuage, 2 crofts and closes in Rushton Spencer (named). Also cottage and barn, Bank Croft, March Croft and The Hill in Rushton Spencer. Water cornmill there in possession of Thomas Nixon. Also the Mill Croft and Long Croft there. Cottage and croft there now Samuel Cloves. The March Croft. Little cottage there now Joseph Rigby's. Altogether 148a.16p. in Rushton Spencer. Messuage and apps. at Windy Arbour, near Talk-on-the-Hill. Also the Barn Meadow, Wear House, Boozey Croft, Rye Croft, Jamage Meadow, Gorsey Field, Line Field, Ford Field Wood, Crestwood, Hancock's Cottage, Hancock's Croft, Hancock's 3 closes, Rough Sidnal, Tanpitt Sidnal, Wobbs in 4 parts, Wobb Meadow, all in Audley. Cottage in Audley divided into 3 parts with apps. and The Wale Hill Bank Close, Audley. All to use of Ursula, wife of Robert Wilmot, the elder, for life.. Then to (2) and heirs for ever. And Borrow Meadow Close in Spondon and Burrow Ash, Derbys. Chicken Holme Close there. Cottage, Long Croft and Garden, Long Croft Meadow, Till Acres, Great Acres Field, Little Acres Field, Great Water Field, Little Water Field, Colepitt Hill and Robins Acre, all at Talk-. Messuage and apps. and closes viz. The Browns Acre, Near Whitmore, Far Whitmore, Old Meadow, 2 Wheat Fields, 2 Talk Heys, Rye Croft, The Hovel, Barn Field and Bank, Little meadow, The Yards als. Barn Field. All in Audley. Messuage and apps. at Foxley, Audley. Cottage and apps. in Shardlow, Derbys, now Wm. Bartram's. Cottage and apps. in Aston, Derbys. A rood ley and a plough field above a rood in Town End Field, Weston-on-Trent belonging to said cottage, formerly of --- clerk and now of Elizabeth Brownhill, widow. Manor of Shardlow, fisheries and several yearly sums of 2/4d; 2/1d; 5½d; 6d; and 1½d. and all rents out of lands in Aston Wilne and Shardlow, Derbys. Now in possession of Robt. Rodston, Robt. Lowne, Simon Roberts, John Williamson, Christopher Wright, Hugh Buckley, Henry Pym, William Bryan, John Pym, John Bryan, Thomas Bryan, John Pryor, Richard Clifford and Christopher Clifford, and apps. To use of (2) and heirs for ever. Lawful for (2) and heirs during life of (1) to dig coal, iron and other minerals on the 2 farms in Audley called Crown Bank and Windy Arbour paying so much per year to (1) for the damage done. Agreed that the said £200 limited to (4) out of Newton Grange should be paid to said Ursula exclusive of her husband. Power of distraint to (4) for said Ursula alone.
