Description(1) Sir Robert Wilmot, Osmaston, Derbys., Kt. and Dame Catherine, his wife, John Eardley Wilmot, Inner Temple, London, Esq. (2) Sir John Heathcote, Normanton, Rutland, Bart. (3) Robert Hucks(?), St. Giles in the Fields, Westminster, Esq. Henry Wilmot, Grays Inn, Middx, gent. Recites: (i) Lease and Rlease of 13/14 June, 1739. (ii) Agreement of (2) with Sir Robt. Wilmot to purchase another annuity of £40 for £1,120 chargeable on the same lands as the other one. Now for £1,120 from (2) to Sir Robt. Wilmot and 5/- from each of (3) to him. Sir Robt. Wilmot to (3) in possession by lease of yesterday, messuages and lands in Weston (described), to secure said extra £40 p.a. to (2) Subject to this use of Sir Robt. Wilmot, J.E. Wilmot and heirs of Sir Robt. Wilmot for ever. Usual covenants. Power of distraint to (2). Lands clear except for said £260 annuity and mortgage of 1 Jan. 1730 and assignment thereof of 14 June, 1739 on which is endorsed a deed poll of even date herewith agreeing to said trust and extra £40 annuity. Sir Robt. Wilmot and Catherine his wife agree with (2) that before the end of next Easter term they will levy a fine of all said premises. To use to secure to (2) and heirs said several annuities. Subject to this to use of Sir Robt. W. and J.E.W. and heirs of Sir Robt. for ever. Sir Robt. W. to do any further necessary deeds of further assurance. Agreed by said J.E.W. that his name is used only in trust for Sir Robt. W. and heirs.
