TitleAssignment of Terms
Description(1) Thomas Allestree, Alveston, Derbys, Esq. John Ward, the younger, Mickleover, Derbys, clarke, Exors of the will of Robert Wilmot, late of Chaddesden, Derbys, Esq. decd. (2) Robert Wilmot, the elder, Osmaston, Derbys. Robert Wilmot, the younger, son and heir app. of the said R.W., the elder, Esqs. Recites: (i) Marriage Settlement by Lease/Release of 13/14 Jan. 1730 of Robt. Wilmot then the younger and Ursula Marrow by which and by a Common Recovery by which lands in Spoondon and Borrowash, Derbys. and various lands in Weston-on-Trent, Derbys and at Audley, Staffe, and 1/5th of the Manor of Rushton Spencer, Staffs and other lands there are settled to Robert Wilmot, the elder, for life with remainder to Elizabeth Wilmot (since decd.) his wife for life with remainder to the said Robt. Wilmot the younger for life, remainder to Trustees for term of 500 years. And also by said deeds various lands in or part of Newton Grange, Derbys. with other lands in Weston are settled upon Robt. Wilmot the younger and Ursula Marrow for life which with £25 p.a. was for her joynture with remainder to trustees for term of 500 years. Said terms were in trust to raise portions for younger children of marriage. Subject to this said premises are limited to the sons of the marriage in tail male. (ii) Marriage having taken place Robt. and Elizabeth Wilmot having been dead for some time and Robt. and Ursula having 3 children, 1.e. Robt. Wilmot the younger (party hereto) 22 years; John Eardley Wilmot, 21 years; and Annabella, now the wife of James MacCulloch, gent, nearly 18. Robt. Wilmot of Chaddesden being the last surviving trustee and (1) being his exors., terms become vested in them. (iii) Robt. Wilmot of Osmaston by settlement of 28 Sep. last has appointed that £4,000 should be settled thus, £3,999.19s. to John Eardley Wilmot and 1/- to Annabella McCulloch. (iv) Payment of sum to J.E. Wilmot by R. Wilmot the younger and direction of J.E.W. of 29 Sep. last that said trustee should assign said terms and premises to (2). (v) (2) having requested (1) to assign said terms and premises to them. Now (1) to (2) for 5/-. Messuages and lands etc. herebefore mentioned to be vested in (2) for said several terms of 500 years or extinguished. Admitted in Court at Derby 9 Oct. 1730, before Master in Chancery. Enrolled 21 Dec. 1730.
