TitleAssignment of Term in Trust
Description(1) Thomas Gisbourne, Derby, Esq. (2) Sir Robert Wilmot, Osmaston, Derbys. Kt. (3) Sir John Heathcote, Normanton, Rutland, Bart. (4) Edward Wilmot, Middle Temple, London, Esq. John White, Wallinwells, Notts, Esq. Recites: (i) Lease and Release of 20/21 Jan. 1729. (ii) Levying of 2 fines and recoveries in pursuance of (i). One each for lands in Staffs and Derbys. (iii) Demise of 1 Jan. 1730 from Wilmots to (1) for £8,000 of said lands in Weston, for term of 1,000 years at 1 peppercorn. (iv) Demise not redeemed. (v) 3 deeds poll of 22 Jan. 1729 whereby the Robt. Wilmots, Edward Wilmot and Robt. Charnells to pay their debts with the mortgage money. (vi) Said payment of debts being made. (vii) Deed to Lead Uses of Fine of 3/4 May, 1732. Promise of Wilmots to levy 2 fines of said property and fines having been levied by which all became vested in (2) yet subject to the aforesaid demise. (viii) (2) being therefore entitled to redemption of said demised premises. (ix) (3) having agreed with (2) for the purchase of an annuity of £260 out of said lands in Weston for £8,000. (x) Lease and release of even date of said premises from (2) to (3). (xi) Payment by (2) of all interest due to (1) and agreement that £8,000 paid by (3) should be used to pay off (1) and mortgage should then be assigned to (4) for residue of term in trust to pay said annuity and subject thereto for (2) to attend upon the inheritance. Now for £8,000 from (3) to (1) and for 5/- from each of (4), and for 5/- each from (3) and (4) to (2). (1) and (2) to (4). All said lands in Weston. And all lands of (2) in Weston. For residue of term in trust as aforesaid. Usual covenants. (2) agrees to pay the said £260 yearly to (3). Power of distraint to (3). (2) to do any necessary deeds of further assurance.
