TitleAssignment of Terms
Description1. John King, St. Martin in the Fields, Mddx., gent, and Gertrude, his wife, dau. and only surviving child of Saml. Trefises, Esq., and Alice, his wife, who was the dau. of Sir Robt. Cotton, late of St. George Hatloy, Cambs., Kt., the surviving trustee of the terms hereinafter mentioned, and sole administratrix to the said Robert Cotton. 2. Dame Jane Cotton, Stratton, Beds., widow and relict of Sir John C., Bart., decd., Thomas Hart and Jane, Wye, Warfield; Thomas Bowdler, Ashby, Wilts., Esq., and Eliz. Stuart, his wife, Frances Cotton, and Mary Cotton, Stratton, spinsters. The four women being the daus. and heirs of Sir John Cotton, decd. 3. John Pierce, St. Andrew, Holborn, Middx., gent. Recites: 1) Indenture of 15 July, 1693, by which Robt. Cotton to provide for Eliz his wife, agreed to levy a fine on his property in Gidding A./S. Gidding (names and acreages given, as before), Hamerton, Hemington, Denton, Sawtrey, Fowkesworth, Caldecot, Stilton, Huntingdon, Godmanchester, Yaxley, and quit rents of £20 p.a. out of the Manors of Conington and Hemington, and all places where Sir John Cotton, the grandfather, had any estate, except 1 messuage, cottage and 120a. in Sawtry Beames and Sawtry Moines. To following uses: Manor of Gidding A. with apps., Manor of Sawtry Beames with Advowson of Sawtry St. Andrew, Anerley Park, all lands in Gidding and Sawtry with named exceptions, to several uses now determined, with remainder to Sir John Cotton, the grandfather. Advowson of Denton Church to said Sir John C., the grandfather for 99 years, then with manors of Denton and Hemington, lands in Stilton, Folkesworth, Caldecot, Huntingdon, Godmanchester with hall and yards in Gidding and pastures called Thurloe, Hanghill, and Hanghill Meadow to Robt. Cotton, for 99 years. After his death, Stilton to his wife for jointure. then all to Sir John C., herein mentioned, for life, then to his heirs in tail male, then to second son of Robt. and Eliz. in tail male, then to their other sons in tail male. To use of Sir Robt. Cotton and Philip C. for 200 years on trust with remainder to Sir John Cotton, the grandfather. Great Walk, Stainpalls (?) Meadow, Alpitts, 2 meadows (35a.) to use of Sir John C., the grandfather, for 99 years, with remainder to Robt. Cotton for life, to Sir John C. in tail male, then to second son of Robt., in tail male. To use of Sir Robt. C., and Philip C. for 300 years in trust with remainder to Sir John Cotton, the grandfather. Terms of 200 and 300 years limited to Sir John Cotton and Philip C. on trust that if Robert and John fail with issue male and have issue female Sir Robert Cotton or survivor should raise from the said premises £7,000 for her/their portions. Provided for John C. to make a jointure for his wife not exceeding £400 p.a. 2) Lease/Release of 5/6 October, 1711, making said jointure for Jane Cotton. 3) Death of Sir John Cotton, the grandfather, Robert and Eliz. and John C. without male issue, but with 4 daus. (named) who become entitled to the £7,000. 4) Daus. inheriting afore-mentioned premises comprized in the said terms, and expectant on the life estate of Dame Jane as aforesaid. 5) Payment of £7,000 and therefore satisfaction of terms. Daus. and husbands (in 2) wish terms to be assigned to 3. in trust as to such part of the premises as are comprized in the said life estate of Dame Jane C. for life and after her death in trust for the rest of 2. They therefore have applied to 1., in whom the said estates are legally vested for the residue of the terms to assign the same for the purposes aforesaid. Now for 5/- paid by 3. to 1. by direction of 2., have assigned to 3. the said Manors and lands for the 2 terms specified. Endorsed: (1) Assignment of Term (Deed Poll) 9 May, 1769 From John Pierce Recites: (i) Marriage of Mary C. and Bazill, Baron of Hapsburg and Earl of D. and D; Death of Thomas Hart; Right of him, and Jane, his wife, to within-mentioned manors and lands invested in John Hart C., their only child. (ii) Recent death of Dame Jane C. Now for 5/- paid to John Pierce by Henry Wilmot, Bloomsbury Sq., Pierce, by direction of John Hart C., Earl and Countess of D., Thomas Bowdler and his wife, and Frances C., has assigned to Wilmot: All the within-mentioned manors and lands comprised within the said terms of 200 and 300 years and all estate of 3. in them for the residue of the terms on trust for J.H. Cotton; The Earl and Countess; the Bowdlers, and Frances C. (2) Assignment of Term (Indenture) 22 Jun. 1771 1. Henry Wilmot, Bloomsbury Sq., Esq. 2. John Hart C., Warfield. Frances Cotton. Thomas Bowdler, Bath. Earl and Countess of D. 3. Taylor White, Lincolns Inn, Esq. Recites: (i) Endorsement of indenture of 9 May, 1769 transferring terms to 1. (ii) John Heathcote of Luffenham purchasing the respective 4th parts of the Manor of Gidding Abbots/Steeple G. with lands in S. Gidding and Hamerton by Lease/Release of 22/23 June, 1771, for £22,800. Now for 5/- paid by 1. to 3., 1. at direction of 2. hath assigned and transferred to 3., the manors and lands in the terms for the residue of the terms on trust, for the use of John Heathcote.
