Description1. James Innes, late of Yarmouth, and now of - Esq., and the late Capt. of H.M.S. The Rye. 2. Robert Boothby, Low Layton, Esq., only son and heir of Thomas Boothby; late of Chingford, Esq., decd. 3. Sir Gilbert Heathcote, Normanton, Rutland, Bart. 4. Samuel Seddon, St. James, Westminster, gent. Recites: 1) Indenture of 31 Dec. 1762 between 2. and Wm. Edwards. 2) Deed of 4 Nov. 1763 endorsed to effect that £1500 in 1) was 1's and name of Wm. Edwards was used only in trust for 1., Wm. Edwards assigned to 1. all lands etc. in said indenture. 3) Now owing to 1. £1500. 4) 3. having agreed to lend 2. £4,800 on a mortgage of the above-mentioned lands, assigned by Edwards to 1. by lease and Release of yesterday and today. And agreed that out of £4,800 3. should pay to 1. £1500 and term of 500 years should be assigned to 4. upon the trusts hereinafter mentioned. Now for £1500 from 3. to 1. and 5/- from 4. to 1., 1. by direction of 2. and at nomination of 3., to 4. Manor of Chingford Comitis als. Chinckford Comitis with apps. which were granted by above-recited indenture. For residue of term in trust for 3. until he shall be fully payed £4,800, then in trust for 2. to be assigned as he shall direct. until such assignment in trust to wait upon the freehold to protect from mesne incumbrances.
