DescriptionCase. John White was seised of estates in East Retford and Walling Wells other than those mentioned in the will. They all descend to his bro. Taylor White as heir-at-law, but the personal estate is not enough to pay all the debts and charges. Although Taylor White, the elder, is willing to settle these estates according to his brother's will, this will not to be fair to his own younger children. He therefore proposes that all the terms of years mentioned in the will be merged and that he has a life interest in the whole, charged with legacies and annuities in will, and that a term be raised sufficient to pay all the debts and charges and the £1,000 for his eldest son. Counsel's opinion is that an Act of Parliament must be passed to put this into effect and thus relieve the family. Neither Mary White nor John Heathcote could put the present will into operation, it seems to have been made under undue influence to vex his family. If Mary White opposes idea of this Act, suit should go to Chancery. Counsel: C. Yorke.
