TitleStatement of Case (by Mr. Forsyth) Queries by exors. and guardians of the present Sir Gilbert Heathcote, Dame Elizabeth Heathcote and John Heathcote, bro. of the late Sir Gilbert.
DescriptionThe real estate which has devolved on the present Sir Gilbert needs much repair. If the codicils of his father's will are fulfilled with their provision for the younger children the personal estate will be exhausted, and Sir Gilbert have no ready money. Under the will the younger children have no guardians and the exors. no authority to reimburse themselves for expenses incurred. The exors. want to know if they should, and will be paid for, repairing and managing estate during minority. If personal estate is exhausted are the exors. to pay Sir Gilbert's income out of the real estate? Will Chancery grant an allowance for Sir Gilbert during his minority and guardians and allowances for the younger children without a bill? Does ambiguity of codicils merit a suit in Chancery re. younger children's rights? Would such a suit bring the management of the younger children under jurisdiction of Chancery?. General directions sought on how to implement Will and Codicils.
