TitleJohn Heathcote's Opinion of the Draft Chancery Bill.
DescriptionThinks that it need not concern itself with the present Sir Gilbert, as he has sufficient authority under the will to be his guardian. His only queries were whether he should repair and maintain Sir Gilbert's estates during the minority and whether he would be justified in paying for his maintenance and education out of the produce of his real estate. The second is answered as he thinks that there will be enough money to provide for the younger children and to maintain and educate Sir Gilbert out of the personal estate without touching the real. Thinks Chancery need only answer re. the repair of the estates. And give opinion re. codicils re. younger children to prevent any further misunderstanding between them and Sir Gilbert, when they come of age. Also wants the Court to appoint guardians for the younger children, as their father did not. One copy endorsed: (i) Mr. Madocks (counsel) is asked to peruse the draft bill and these remarks and to alter the form of the bill as far as he thinks proper to meet Mr. Heathcote's ideas. (ii) Mr. Maddocks comments that the bill as it now stands altered applies only to the personal estate and the questions upon the legacies. Does not involve real estate. Deeds of settlement re. younger children are only in the bill to show how they are provided for and may help to understand the Codicils.
