Description(1) Charles Harding at present of Ivanpore, East Indies, Esq., in the Civil Service of the United Co. of Merchants of England, trading to India on their Bengal Establishment, and Eliza Ann his wife (late Eliza Ann Hamilton, spinster) eldest dau. of Sir Fredk. Hamilton, Bart, now residing at Benares, East Indies. (2) Sir Frederic Hamilton, William Judd Harding, Esq., also of Benares and Richard Campbell Bazett and David Colvin, both of the City of London, merchants. (3) Robert North Collie Hamilton of Benares, aforesaid, Esq., the eldest son of the said Fredk. Hamilton. (4) John Heathcote, Conington Castle, Esq. and Bigoe Charles Williams, Lincolns Inn Fields, Esq., surviving exors of Dame Anne Hamilton, late of Lower Grosvenor St., widow. (5) Charles Mills, the younger, Birchin Lane, London, banker, James Molony, Kiltannon, Co. Clare, Ireland, and of Wellesbourne, Warwicks, Esq., and the said Bigoe Charles Williams. Recites: (i) Marriage settlement of (1) of 24 June, 1820 by which (1) appointed (2) and William Harding, Esq. (since decd.), their attornies to receive monies from the exors. of the will of Dame Ann Hamilton, with power to appoint new trustees. (ii) Death of Wm. Harding and desire of Richard Campbell Bazett and David Colvin to be discharged from their trusts therefore (2) with consent of (1) have agreed to appoint (5) as trustees in their stead. Now they doso. (iii) (4) as surviving exors of Dame Ann H., about a year ago furnishing the accounts of the personal property of the said Dame Ann, to ½ of which the said Eliza Ann Harding is entitled under the will of Dame Ann Harding, and (3) is entitled to the other half, both now being 21. (iv) (4) having transferred £3,339.5.4d. 3% reduced annuities and £625 Bank Stock (being ½ of the aforesaid estate) to (5) as the 3 trustees resident in Great B. and the other ½ into the joint names of (3) and Bazett and Colvin acting under power of attorney of (3) of 23 April, 1823. Now (1) and (3) release (4) of all claims re. Dame Anne Hamilton's personal estate and agree to indemnify (4) from all loss re. said estate. (1) agrees with Bazett and Colvin to indemnify them and their heirs from all claims re. these trusts.
