Description(1) John Moyer Heathcote, Conington Castle, Esq. and The Rev. R.B. Heathcote, Great Friday Hill, Chingford, Essex, clerk. (2) The Rt. Hon William Henry Viscount Downe. (3) The Commissioners for improving the town of Whitby, under an Act of 7 Wm.IV. (Under an Act of 4 Vict. for rendering a release as effective for conveyance as a Lease and Release) Recites: (i) Release of 8 May, 1849 giving (1) power, by direction of tenant for life, to sell part of the hereditaments mentioned. (ii) (1) by direction of (2) have contracted with (3) for the sale to them of the property hereinafter described for £810. Now for £810, (1) to (3) by request of (2), revoke the trusts of the Indenture of 8 May, 1849 re the property hereinafter described and appoint that premises shall be to use of (3) for ever. (1) and (2) to (3). Freehold messuage or burgage(?) house and shop in Haggersgate, Whitby. Also cottage with a granary or warehouse adjoining, bounded by the New Quay or Pile on the east, public streets on west and south, and by a warehouse and premises of John Corner on the north, with all outhouses and apps. Usual covenants. Attached: Schedule of deeds to which indenture refers.
