TitlePetition for Appointment of New Trustees In Chancery re. the Trusts of Marriage Settlement of 8 May, 1849, and re. the Trustee Act, 1850.
DescriptionPetition by Viscount and Viscountess Downe and Hugh Richard Dawnay, their eldest son. Recites: Indentures of 21 July, 1843 and 8 May, 1849 Trusts therein and provisions to appoint new trustees. Recites sale of various lands under said trusts - i.e. messuage etc. in Haggersgate at Whitby and an adjoining cottage, 27a.12p. land at Snaith; 1r.1p. at Lowgate, Snaith; 3r.24p. a close in Conick Field, Snaith; 3 Cottages in the Beast Fair Snaith; 2 houses in the High St. Snaith = 21p.8a.3r.32p. being a close called North Carrs at Camblesforth, Drax; 1r.21p. at Pollington, Snaith; Dwelling-house of 2r.1p. there. 2 houses at Snaith (31p.); messuage of 2r.24p. and a garth of 14p. and North Lane Close (4a.1r.21p.) and Jacksons Close at Cambleforth (3a.3r.23p.) Other closes at Cambleforth - Spring Close Wood (11a.3r.14p.), East Hurn Close (11a.3r.21p.), Great Close (13a.3r.18p.), Pinfold Lane (2r.17p.), Nine Acres (10a.2r.), 10 Acres (10a.3r.21p.), West Hurn Close (9a.2r.11p.), Well Close (7a.2r.1p.), Common Close (4a.3r.33p.), at Cambleforth. House and butcher's shop at Snaith (29p.); house and shop in the Beast Fair in Snaith; 2 houses and shops in Snaith (1r.19p); Saffron Garth Close there (3r.), 2 houses there (1r.8p.). Total purchase price of £6,325 has been paid to J.M. and R.B. Heathcote, as trustees. These two now wish to be relieved of the trusts and that Frederick Thompson of Sheriff Hutton, Yorks, Esq. and The Rev. Frederick Bagot, Rector of Rodney Stoke, nr. Wells, Somerset, are proposed as the new trustees. The court is being approached because there is some doubt about the competence of the Heathcotes to appoint new trustees.
