| Description | (1) John Moyer Heathcote, Conington Castle, Esq. and  The Rev. R.B. Heathcote, Great Friday Hill, Chingford, Essex, clerk.  (2) The Rt. Hon. William Henry Viscout Downe.  (3) John Appleton, Cowick Snaith, Yorks, bridklayer.  Recites; (i) Indentures of 20 and  21 July, 1843, 28 Nov. 1846 and  8 May, 1849, by which premises hereinafter described were conveyed to use of (2), and by which it is declared lawful for (1) at request of tenant for life, to sell the premises and  to revoke any of the uses and  trusts thereinbefore limited, and  to declare new uses and  trusts.  (ii) (3) has contracted with (1) to buy the premises for £150, by direction of (2).  (iii) (2) has consented to enter into the covenants hereinafter contained.  Now (1), at request of (2) revoke all the uses and  trusts in Indentures of 21 July, 1843 and  8 May, 1849 so far as they affect the premises hereinafter described, except the power to limit those premises to the uses hereinafter declared.  (1) for £150, to be disposed of by (1) according to the trusts of indenture of 8 May, 1849, appoint that the hereditaments hereinafter described shall be to the uses and trusts hereinafter expressed, and  for 10/- to (2).  (1) and (2) to (3).  Three dwelling-houses or cottages in the Beast Fair in Snaith, Yorks (26perches) bounded on the east by property of (2), by property of Henry Rogers on the west, by the Beast Fair on the north, and  the Fieldside Rd. on the south, with all apps., subject to ½ the expenses of maintaining and  supporting the well in the said premises and  to the rights of the owner of the hereditaments on the east to get water from said well and  maintaining the fence between the hereditaments and  those of William Fisher.  To use of (3) for ever. And (3) declares that his widow shall not be entitled to dower out of said premises.  Usual covenants.  Added: Draft receipt from (1) to (3) for £150. |
