Description(1) John Moyer Heathcote, Conington Castle, Esq. and The Rev. Robt. Boothby Heathcote, Great Friday Hill, Chingford, Essex, clerk. (2) The Rt. Hon. William Henry Viscount Downe. (3) The Rt. Hon. Miles Thomas, Lord Beaumont. (4) Henry Eadon, Snaith, Yorks, Esq. Recites: (1) Indentures of 20 July, 1843, 21 July, 1843, 28 Nov. 1846 and 8 May, 1849 by which premises hereinafter described were conveyed to use of (2) and by last one declared lawful for (1), at request of tenant for life, to sell the premises and to revoke any of the uses and trusts thereinbefore limited, and to declare new uses and trusts. (ii) (2) seized according to the custom of the Manor of Carlton, Yorks, of copyhold lands hereinafter declared to have been surrendered lying intermixed with the freehold hereditaments hereinafter described and intended to be hereby released and conveyed. (iii) (1) at request of (2) have agreed to sell freehold and copyhold lands to (3) for £1,400 and (3) has requested for them to be conveyed as hereinafter mentioned. (iv) (2) consented to enter into the following covenants for title. (v) To ascertain the Advalorem duty re. such purchase it has been agreed between (1) and (2) that £1,260 shall be the price for the freehold and shall be paid to (1) and £140 the price for the copyhold to be paid to (2). (vi) In part performance of the covenant and for £140 from (3) to (2), (2) surrendered out of court said copyhold hereditaments by description of - copyhold parcel of land (1a.2r.8p) on the west side, part of an allotment of 3a.5p. late parcel of the Butt Hole Field in Carlton, Snaith, Yorks, awarded to John Bingley by the Inclosure Commissioners, with land of (2) on the east, land of (3) on the west, the north field road on the north and land of the heirs of John Robinson decd. on the south. And copyhold parcel of land (1r.37p.) on the north side, part of an allotment containing 2a., awarded to Thomas Webster by the Inclosure Commissioners, bounded by the Jugs Rd. on the east and by land of (3) on west north and south. And copyhold parcel (1a.20p.) on the north side, part of an allotment of 2a.3r.12p. late parcel of the Mill Field of Carlton, allotted by the Incl. Comm. to Edward Hall, bounded by land of Wm. Oxenforth on the east, that of Thomas Newby on the north, Long Hedge Rd. on the west, land of the Trustees of Drax School on the south, with apps. all more particularly described and coloured red on the accompanying map, to use of (2) Lord of the said Manor. Now (1) at request of (2) revoke all the uses and trusts in Indentures of 21 July 1843, and 8 May, 1849, so far as they affect freehold premises hereinafter described, except the power to limit those premises to the uses hereinafter expressed. (1) for £1,260 from (3) appoint that the hereinafter described lands shall be for the uses and trusts expressed and for 10/- to (2), (1) and (2) to (3). Freehold lands in Carlton: Pighill Close (1a.2r.) bounded by land of Thomas Hinsworth on east and west, Thomas Hinsworth and John Hepworth on north and the Jugs Pickhill Rd., on south. Late part of the Jogs of of Carlton (9a.3r.) bounded by land of Thomas Hinsworth on the east, Short Hards Drain on west, Pighill Close on north and Dam Dike Drain on south. Close late part of the Butt Hole and North Fields of Carlton (11a.20p.) bounded by Long Hedge Rd. on the east, by the next described close on the west, North Field Rd. on the north and land of John Robinson decd. on the south. Parcel (1a.1r.37p) on the east side, part of an allotment of 3a. and 5p. late parcel of Butt Hole Field, allotted by Incl. Comm. to John Bingley, bounded by the last described close on the east, lands of (3) on the west, North Field Rd. on the north and land of the heirs of John Robinson, decd., on the south. Parcel (1a.2r.3p.) on the south side, part of 2a. allotted by the Incl. Comm. to Thomas Webster. Bounded by Jugs Rd. on the east and land of (3) on the west, north and south. Parcel (1a.2r.32p.) on the south side, part of 2a.3r.12p. late parcel of the Mill Field of Carlton, allotted by the Incl. Comm. to Edward Hill, with land of Wm. Oxenforth to the east, land of Thos. Newby to the north, Long Hedge Rd. to west and land of Trustees of Drax School to the south - all described and coloured blue in accompanying map. With all apps. To such uses as (3) shall appoint or to use of (3) for life. Then to use of (4) during life of (3) in trust for (3), so that (3)s widow shall not be entitled to dower out of it. Then to use of (3) and heirs for ever. Usual covenants. Added: Schedule of deeds referred to. Draft receipt from (1) to (3) for £1,260. Endorsed: Request from lawyer to counsel to peruse the deed.
