Description(1) John Moyer Heathcote, Conington Castle, Esq. and The Rev. Robt. Boothby Heathcote, Great Friday Hill, Essex, clerk. (2) The Rt. Hon. Wm. Henry Viscount Downe. (3) John Bramley, - Yorks, potato merchant. (4) Henry Eadon, Snaith, Yorks, Esq. Recites: (1) Indentures of 20 and 21 July, 1843, and 28 Nov. 1846 and 8 May, 1849, by which hereditaments hereinafter described were conveyed to (2) and by last-named indenture it is declared lawful for (1), at request of tenant for life, to sell the premises and to revoke any of the uses and trust thereinbefore limited, and to declare new uses and trusts. (ii) (1) at request of (2) have contracted with (3) for the sale of the piece of land hereinafter described for £80 and (3) has requested that it may be conveyed to the uses hereinafter contained. (iii) (2) has consented to enter into the covenants hereinafter contained. Now (1) at request of (2) revoke all the uses in Indentures of 21 July, and 8 May, 1849 so far as they affect the premises hereinafter described except the power to limit those premises to the uses hereinafter expressed. And (1) and (2) to (3) for £80, to be disposed of according to the trusts of Indenture of 8 May, 1849, appoint that the premises shall be to uses and trusts hereinafter declared, and for 10/- to (2). (1) and (2) to (3). All that piece of land now used as a garden, with the shop thereon in Lowgate, Snaith, Yorks, (1r.1p.) bordered on the east by the property of Thomas Leetham, on the west by that of John Killingbeck, on the north by that of the Lancs. and Yorks Rly. Co. and on the south by the road, with all apps. To such uses as (3) shall appoint or to use of (3) for life; then to use of (4) during life of and in trust for (3), to the intent that (3)'s widow may not be entitled to dower out of them. Then to use of (3) and heirs for ever. Usual covenants. Added: Draft receipt from (1) to (3) for £80.
