Description(1) John Moyer Heathcote, Conington Castle, Esq., and The Rev. Robt. Boothby Heathcote, Great Friday Hill, Chingford, Essex, clerk. (2) The Rt. Hon. William Henry, Viscount Downe. (3) Joshua Cook, Snaith, Yorks., gent. (4) Henry Eadon, Snaith, Esq. Recites: (i) Indentures of 20 and 21 July, 1843, 28 Nov. 1846 and 8 May 1849, by which premises hereinafter described were conveyed to use of (2). Last-named indenture declares it lawful for (1), by direction of tenant for life, to sell part of the premises and to revoke the uses therein before limited. (ii) (1) at request of (2), tenant for life, have contracted with (3), to sell him the premises hereinafter described for £242, and (3) has requested that the same may be conveyed to the uses and in manner hereinafter contained. (iii) (2) has consented to enter into the covenants hereinafter described. Now (1) at request of (2) revoke all uses and trusts contained in the before-recited indentures so far as they affect the premises hereinafter described. (1), at request of (2), for £242, to be disposed of according to the trusts of indenture of 8 May 1849, appoint that said close of land with apps. be to trusts and uses hereinafter expressed. And for 10/- to (2), (1) at request of (2), and (2), to (3). Close of land in or near Cowick field, Snaith, Yorks, (3r.24p.), bounded on east by property of Nicholas Edmund Yarburgh, Esq., on west by property of (3) and of the trustees of Snaith Wesleyan Chapel and Schools, on the north by Marsh Lane and south by Thorne Rd., with all apps. To such uses as (3) shall appoint. In default of such appointment to use of (3) for life. After determination of that estate to use of (4) during life and in trust for (3), to the intent that widow of (3) may not be entitled to dower from them. Then to use of (3) and heirs for ever. Usual covenants. Endorsed: Draft receipt from (1) to (3) for £242.
