DescriptionWhite prepared all the conveyances last term for Mr. Bertie and his trustees to execute but was obliged to leave the affair unfinished because Mr. James Mead, surviving trustee of a term of 1,000 years to secure £6,000 for Mr. Bertie's younger children refused to execute those conveyances. White has returned immediately to London at end of circuit in Chester to try and persuade Mead amicably. Mead has promised to do as White advises but when White prepared a deed saying that Richard and James Bertie had attained 21 and received their portions and only £2,000 due to Montague Bertie remained and prepared a covenant that when that sum was paid then Mead would assign the term to a trustee named by H. attend the inheritance and in the meantime stand siesed of the premises subject to the said payment in trust for you; a covenant that he had done nothing to encumber. He utterly refuses to execute that deed or any other. Very difficult because Mr. Bertie is engaged to pay the purchase money to discharge other debts. He is dead in the Bank. And the loss expense and delay will be very great if they bring a Bill in Chancery to oblige the trustee to assign. Suggests that the two Mr. Berties who have attained their age make an assignment of their interest in the term to H. and H. retains the other £2,000 till Mr. Montague Bertie comes of age and Mr. Bertie gives a reasonable security that he would then at his own expense procure from the trustee an assignment of the Trust Term. That seems a reasonable expedient to prevent further expense and loss. Not regular but as Mr. Bertie is a gent of credit and fortune may be safe and White thinks it right. If approved the £2,000 need not lie dead for Mr. Bertie will want that money on another security until Mr. Montague comes of age.
