| Description | Recites: 1) Settlement by Lease and Release of 17th-18th April, 1739 (Hinch/1/11) 2) Writing endorsed on above Release. 3) Will of Charles Viscount Fane, senior. 11th May, 1739. Devised and limited his lands in cos. Limerick and Tipperary to Sir Standish Harstonge and Hon. Charles Stanhope for term of 500 years upon trusts to raise certain sums of money. Mortgage (by demise for 500 years) 1) Charles Lord Visc. Fane snr. 2) Jerome de Salis, and Mary his wife. 3) Rt. Hon. Richard, Lord Visc. Cobham, William Earl of Harrington, and Sir Luke Schaub. For £4,000 to 1. from 3. (towards Hon Dorothy Fane's marriage portion) 1 demised to 3. all his lands in cos. Limerick and Tipperary. 5) Death of Charles Lord Visc Fane, snr. 1744 Charles Lord Visc. Fane, his only son, succeeded to the titles. 6) Decree of High Court of Chancery 3rd May, 1748 Declared that will of Charles Lord Visc. Fane snr, was well proved and ought to be established. 7) Mortgage (by demise for 1,000 years) 30th May 1746. 1. Charles Lord Visc. Fane jnr. 2. Henry Fane of p. of St. James Westminster, co. Middlesex, Esq. For £5,000 to 1 from 2. 1 Demised to 2. all his lands in cos. Armagh, Limerick and Tipperary. 8) Act of Parliament (22 George II) entitled "An Act for Sale of the Inheritance of part of the settled estates of Charles Lord Visc. Fane in cos. Devon and Limerick for discharging debts and incumbrances and also for settling another estate in co. Berkshire in lieu thereof." Enacted that lands in cos. Devon and Limerick were freed from all previous trusts etc. and were vested in Richard Dawson and Walter Dawson of the City of Dublin, Esquires, upon trust to sell all or part of the lands to raise certain sums of money. Any unsold land to be vested in R & W Dawson in trust to settle it subject to the limitations in the settlement of 1739 (recital 1) referring to co. Limerick. 9) R & W Dawson sold the estate in co. Devon and several parts of the estate in co. Limerick. Money still remained to be raised from the lands in co. Limerick for the purposes mentioned in the schedule annexed to the present indenture. 10) Death, without issue, of Charles Lord Visc. Fane jnr. and 2 of his 4 sisters. Their mother also dead. The heirs are the 2 other sisters, Mary de Salis and Rt. Hon. Dorothy Countess of Sandwich. 11) Death of W & R Dawson. 1. is R. Dawson's eldest son and heir at law. The lands in co. Limerick are now vested in 1. 12) Other deeds concerned with borrowings for and payments of various debts, 1733-1794. Now 1 at the request of 2., releases to 3., to such uses and trusts as follows: i) To use of 1. for term of 2,000 years upon trust that 1. by sale or mortgage of all or part of the lands or from the rents levies sufficient sums to off ½ of the debts mentioned in the recited Act of Parliament as remain due and ½ of the other recited debts. ii) To use of 2. and his heirs. iii) In default of any issue of 2. or of his mother, to such uses as expressed in the recited Act of Parliament and other deeds relating to this land. All that the undivided moiety of 1. in the manors of Loughur, and Glenogry Co. Limerick and in all the towns etc. called Loughur and Castle Gerr, Ballynagra Grange and Six Mile Bridge, Ballinlough, Lahinshee, Caherduff, Drombegg, Kilboys, Killmallocks, Ballyregan, Gregane, Coolygowan and Four Towns, Killycano, Ballynought and Ballyvaloughe, 6 several parts of Glenogry and one other part thereof called Brackmoan, Knockanure, part of Ballycolane, part of Killoragh, part of Brackmoan and part of Ballycolane Manns and Bagwells Meadow.
