TitleAssignment of Terms in Trust
Description1. Stephen White, Castor, Northants, LL.D. Administrator of the goods of Taylor White, formerly of Lincolns Inn, Esq., decd. 2. John Heathcote, Conington, Esq., the mortgager hereinafter mentioned. 3. The Rt. Hon. Sir Joseph Banks, Soho Sq., Middx. Bart, P.C., K.B., and Sir Henry Hawley, Lenbourne Grange, Kent, Bart., the mortgagees hereinafter mentioned. 4. Alexander Murray, Symonds Inn, Middx. gent, a trustee of 3. and 2. Recites: 1) Demise of 10 Dec. 1728. 2) Assignment of 16 Jan. 1732. 3) Assignment of 3 May, 1758. 4) Indenture of 9 Dec. 1758, reciting that the three younger children of Charles Bertie decd. were entitled to £6,000 which Sir John Heathcote had paid, at which (?) James Mead assigned to Taylor White and Noah Curtis the said premises by direction of Sir John Heathcote for residue of the term of 1,000 years in trust for Sir John Heathcote. 5) Death of Curtis in 1759, T.White in 1792. 1. the personal legal representative of T. White, so the two terms of 1,000 years and 1,000 years are now vested in 1. 6) By the will of Sir John Heathcote of 15 June, 1758 and by lease and release of 11/12 Feb. 1800 and a Common Recovery of 1800, 2. became seized of the said premises comprised in the said several terms. 7) Mortgage of 3/4 Dec. 1807. 8) Agreement that the said several terms so far as they concern 3. should be assigned to 4. upon the trusts hereinafter declared. Now in pursuance of said agreement and for further securing of the £11,000 with interest and for 5/- from 4. to 1. by direction of 2. and nomination of 3., 1. to 4. Manors, Moiety, messuages, lands etc. (Camoys Manor in Gt.S., Rectory of Gt.S., moiety of Manor of Broughtons), which by assignments of 3 May and 9 Dec. 1758 were assigned to Taylor White, to hold all such of the premises as are comprised in the terms of £1,000 years by Indenture of 10 Dec. 1728 with all apps. and all such assigned premises as are comprised in the term of £1,000 years by Indenture of 26 July, 1731 with all apps. for residue of terms, on the following trusts: On trust for better securing to 3. the payment of the said £11,000 with interest as declared in the release of even date. In default of such payment of the £11,000 in trust for 2. And in the meantime that the residue of the terms may be assigned as aforesaid to protect the premises from all charges and incumbrances.
