TitleCopy of Case Submitted to Mr. William Cooke for his opinion. Case No. 4.
DescriptionContains copy cases laid before Mr. Trower with his opinions on them. Question still outstanding is whether the late Charlotte Dillon acquired on her marriage a vested interest in 1/5th of Sir Robt. H's personal estate and if Sir Charles Dillon is not now entitled to this 1/5th and if he can be paid his share without letters of administration. Answer is that she did acquire this share and that Sir Charles is now entitled to it. As it is a chose in equity it becomes on marriage vested in the husband by the terms of the settlement. Mr. Cooke is therefore inclined to think that letters of administration are not necessary. The exors. could get out of the difficulty by paying it to the representative of the surviving trustee - but then the problem will recur. Wm. Cooke, Lincoln's Inn.
