TitleDisentailing Deed
Description(1) The Rt. Hon William Henry Lord Viscount Downe, eldest son and heir of the Rt. Hon. and Rev. Wm. Henry Viscount Downe, decd. (2) The Rev. Lewis Francis Bagot, Rector of Leigh, Staffs. Recites: (i) Will of John Christopher Burton Viscount Downe of 19 July, 1819 and thereby gave his freehold estates in Yorks and Rutland and elsewhere to following uses and trusts, i.e. estates in York and Rutland (except the mansion house at Cowick and advowsons and rectories in York and Rutland) to use of Sir Wm. Foulis of Ingleby Manor, Yorks, Bart and Hugh Scott, Mertown, Berwick, Esq. To the following trusts: All lands and property excepted. To his sons in tail. To Sir Wm. Henry Cooper of Feltham, Middx, Bart, and John Heathcote, Conington Castle, Esq., in trust, then to Downe heirs in tail male; then in tail general. (ii) Death of testator on 18 Feb. 1832, with no issue and leaving Hon. and Rev. Wm. Henry Dawnay him surviving. (iii) Death of Rt. Hon. and Rev. Dawnay on 23 May last leaving (1) as his eldest son and heir. Now (1) to (2), under Act of 4 Vict. All his lands etc. in Yorks and Rutland and elsewhere. And all other premises in said Will, to hold to the use of (1) and heirs for ever. Enrolled in Chancery 30 Nov. 1846 at Wakefield 3 Aug. 1847 at Northallerton 6 Aug. 1847.
