DescriptionOf Charles Scruby to freehold property at Linton, Cambridgeshire. a) Property formerly Taylor's 1) Lease and release 1. Henry Webb of Linton, cordwainer (vendor). 2. John Marsh of Linton, cordwainer (purchaser). Freehold messuage or tenement with the outhouses, yard, garden, piece of ground and premises, Linton, near a place called Barham Cross near highway or lane called Horseheath Lane (some time since been divided from the ground or tenement and dwelling house then lately erected upon other freehold premises of Henry Webb) situated next the street or common highway leading from Linton to Bartlow on S and called the Lower House with barn (marked off). Occupation of William Brown and James Wright (free of incumbrances except 7d rent due to the Lord of the manor). CONSIDERATION £63 paid by 2. to 1. 4 and 5 November 1796. 2) Lease for 1,000 years (mortgage in £100 and 5% interest) 1. Daniel Marsh of Linton, cordwainer (eldest son of John, late of same, deceased) (mortgagor). Property as above. 25 January 1806. 3) Lease and release 1. Daniel Marsh (vendor). 2. Daniel Taylor (purchaser). Property as above. CONSIDERATION £135 paid by 2. to 1. 19 and 20 November 1811. 4) Mortgage in £2,000 and interest at 5% (by lease for 1,000 years). 1. Daniel Taylor (mortgagor). 2. Robert Taylor of Linton, gentleman (mortgagee). Freehold messuage or tenement with outhouses, yard, garden, piece of ground, Linton, Cambridgeshire, near place called Barham Cross near the highway or lane called Horseheath Lane (purchased by Daniel Taylor from Daniel Marsh) then in occupation of – AND all other messuages of Daniel Taylor’s in Linton. 5 June 1821. 5) Will of Daniel Taylor (died 1827) residue of lands, tenements and real estate to his brother Robert, sister Mary Taylor and Elizabeth Kidman Taylor (last share reversion to her husband John Kidman and then to their children). Proved in consistory court of Ely 14 April 1827. 6) Will or Robert Taylor (died March 1834) devises certain estates at Hadstock, Essex and property at Linton, Cambridgeshire, THEN residue to niece Elizabeth Taylor Kidman and 2 great nieces Elizabeth Bird and Ann Foster. Appts Elizabeth Taylor Kidman, John Kidman and William Foster executors of will. Made 5 June 1828. Proved PCC 22 June 1837. 7) Lease and release 1. William Foster of Hauxton, Cambridgeshire, and Ann his wife. 2. James Michael Foster of Cambridge, vinegar manufacturer (trustee to enable Ann to leave property by will). Freehold messuages in Linton devised to Ann Foster and in tenant in common under will of Robert Taylor. 7 and 8 November 1837. 8) Certificate of acknowledgement of above by Ann Foster. 29 November 1837. 9) Will of Elizabeth Taylor Kidman (died 29 July 1845). To son John: land in Mill Field, Hadstock, Essex, left to her by her uncle Robert Taylor and ? of her money. To 2 daughters Ann Foster and Elizabeth Bird: her share in residue of will of Robert Taylor, to be equally divided between them. Plate and other property not disposed of she gave to her 3 children to be equally divided between them. Appts son John Kidman and son-in-law William Bird executors of will. Made 12 November 1842. Proved consistory court of Ely. 8 June 1846. 11) Shares in estate a) Ann Foster: 1/3 of 1/3 as one of the 3 children of Elizabeth Taylor Kidman under the will of great uncle Daniel Taylor, ie 1/9; 1/3 of 2/3 under will of Robert Taylor 2/9; ½ of 1/3 of 2/3 under will of her mother Elizabeth Taylor Kidman. TOTAL 4/9th. b) Elizabird entitled to similar share. TOTAL 4/9th. c) John Kidman entitled to 1/3 of 1/3 as other child of Elizabeth Taylor Kidman. TOTAL 1/9th. 12) Conveyance 1. Freehold cottage or tenement with outhouses, yards, gardens, etc in Linton, Cambridgeshire, at or near Bergham alias Barham Cross (9p) formerly part of the premises called the Upper House. Abuts SE high road leading to Bartlow, NE and NW residue of property called Upper House. Then in occupation of Robert Pamenter AND formerly estate of Anne Lofts who by her will made 20 March 1767 (no date or place of probate) devised to her nephew Henry Webb (died intestate 1801) therefore passed to eldest son Henry, above testator. CONSIDERATION £48 paid by 2 to 1. 17 and 18 November 1830. c) Whole property (ie a) and b) combined) 1) Will of Robert Casbolt (died 8 June 1873). Appt Robert Gimson and Thomas Meeks, executors and trustees of his will. If son John Casbolt shall come into possession of his estates, then chargeable to following legacies: children of testator: Susan (wife of Alfred Whiffin), Eliza (wife of William Seekings), Phoebe (wife of Thomas Meeks) and Mary Ann Casbolt AND grandchild John Saggers, alive at decease of survivor of testator and wife: £15 each if die before then legacy to their children, who survive to 21. All real estate to wife Elizabeth for life, reversion to testator’s son John but if he dies during testator or wife’s lifetime, then real estate to be left by Elizabeth. Made 4 June 1868.
