Description1 Sir Alured Clarke of Mansfield Street, p. of St. Mary le bone, co. Middlesex, and Edward Stracey the younger of Parliament Street, Westminster, co. Middlesex, Esq. 2 William Stephen Poyntz of Cowdray, co. Sussex, Esq., surviving guardian of the 7th Earl of Sandwich. 3 William Augustus Montagu of Upper Brook Street, co. Middlesex, Esq. Recites: 1) The will and codicil of the 5th Earl of Sandwich (HINCH 1/1) The parts referring to the 3 legacies of £3,000, £1,500 and £3,000 to 1. in trust for Miss Mary Upcroft and her son, John Montagu Upcroft. 2) Proceedings of the Court of Chancery in a cause between the 7th Earl, by his next friend, and his Guardians. The sum of £7,500 was still due to 1. for the three legacies in trust as above. There was then standing in the name of the Accountant General of the Court of Chancery in trust in the cause £4,612.7s.0d., Bank £3 per cent annuities and £169.1s.11d in cash, which had arisen from the savings of the Earl's real estates. The Earl was advised that it would be to his benefit to pay off £4,500 of the £7,500 from this fund. Now for £3,000 and £1,500 to 1 1 assigns to 3 The two sums of £3,000 and £1,500; to hold in trust for the 7th Earl as a part of his personal estate.
