DescriptionRecites: 1. Lease and Release of 25th-26th September, 1798 (Hinch 2/26-27) and Lease and Release of 27th-28th September, 1798 (Hinch 2/28-29) 2. Mortgage of 2nd May, 1800 (Hinch 2/34-35) 3. Lease and Release of 8th-9th July, 1804 (endorsed on Lease and Release of 25th-26th September, 1798) 4. Lease and Release of 28th-19th August, 1805. (Hinch 2/38) 5. Assignment of 28th-29th August, 1805. (Hinch 2/39). 6. The principal sum of £3,000 and £5,000 secured to 5 and 2 respectively have not been repaid. 7. Death of John Drury. Now for £5,000 by 6 to 2 1,2,3, and 4 release to 6 The land etc., as in the Lease and Release of 28th-29th August, 1805. (Hinch 2/38) And for £3,000 by 6 to 5. 5 assigns to 6 for the residue of the term of 2,000 years. The land etc. as in the Demise of 2nd May, 1800 (Hinch 2/34-35) Endorsed: Lease and Release 14th-15th November, 1820. 1. Thomas Garth, late of the Kings Mews, but now of Ilsington House near Dorchester, co. Dorset, Esq., a General in His Majesty's Service, and John Fullerton, late of Barton House, co. Warwick, but now of Thryberg Park near Doncaster, co. York, Esq. 2. Thomas Garth of Haynes Hill, co. Wiltshire, Esq., a Captain in the Royal Navy. Recites: 1) The will of Charles Boone, dated 4th March 1813. By this he devised to General George Garth of Beverley, co. York., and 1 his personal estate and his other investments, including land in mortgage to him, upon trust to pay the interest from them to his daughter, Harriet, the wife of Sir William Drummond. 2) Codicil to the above (11th July, 1818) He declared that if any of the above trustees died or refused to act, then 2 should be appointed in his place. 3) Death of Charles Boone (March, 1819) and the proving of the will and codicil. 4) Death of General George Garth (June, 1819) 5) Deed Poll of 21st July, 1820. 1 with consent of Harriet Drummond, appointed 2 to be a trustee jointly with them. 6) The sum of £8,000 is still due to 1, as surviving devisees in trust and executors of Charles Boone, from the Earl of Sandwich. Now 1 release to 2 (to hold to the use of 1 and 2) The land etc. as in the Assignment of Mortgages of 27th-28th November, 1812. (Marked no. HINCH 5)
